Scope of Application

By accessing or using the Site or purchasing products through it, you (”you” or ”User”) agree to be bound by these Terms & Conditions (the ”Terms”). If you do not agree to all the Terms, please refrain from using the Site or placing an order.

Definitions

”User” or ”you” means any individual or entity accessing or using the Site or purchasing Products.
”Products” means the mattresses, latex pillows and related sleep accessories sold on the Site.
”Services” means all online services provided through the Site, including but not limited to product display, ordering, payment, and delivery.

Orders & Pricing

We endeavour to display prices, colours, images and descriptions of Products as accurately as possible; however, we do not guarantee that your monitor’s display of any colour will be accurate.
All prices, promotions, product descriptions and delivery details are subject to change without notice.
We reserve the right to limit, refuse or cancel any order in our sole discretion, including for reasons such as inventory shortage, pricing error, suspected resale, or abnormal orders.

Payment & Delivery

By placing an order, you agree to pay the price shown at checkout and any applicable delivery or other charges.
We will arrange for delivery of Products to addresses within Australia. Delivery charges, times and conditions will be as stated at checkout or in order confirmation.
We will not be liable for any delay in delivery caused by events outside our control (including courier delays, natural disasters, customs clearance, etc.).

Returns & Exchanges Policy

Noting that the Site currently states ”101‑night sleep trial Coming Soon.”, we do not yet provide the 101‑night trial service.
If a Product is defective (i.e., not due to your misuse or improper handling), we will comply with applicable laws (including the Australian Consumer Law) and provide repair, replacement or refund.
We do not accept returns or exchanges simply due to change of mind (for example, you decide you don’t like the feel, size or material).
Please inspect your Product upon delivery and notify us within 7 days if you discover obvious damage or defects.
We reserve the right to amend our Returns & Exchanges conditions (including whether to collect items, who covers shipping costs, whether re‑sale or donation of returned items is permitted) and will notify you via the Site or order confirmation email when we do so.
These Terms do not affect your statutory rights under the Australian Consumer Law.

Intellectual Property

The Site and its contents (including but not limited to text, images, logos, trademarks, software, layout) are owned or licensed by us.
You may not reproduce, modify, lease, loan, sell, distribute, create derivative works of the Site or Services without our prior written consent.

Disclaimer & Limitation of Liability

The Site and the Services are provided on an ”as is” and ”as available” basis. We do not guarantee uninterrupted or error‑free service.
To the fullest extent permitted by law, we exclude all liability for any indirect, incidental, special, punitive or consequential damages arising from your access to or use of the Site or Products.
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be deemed to be removed and the remaining provisions will nevertheless continue in full force and effect.

Termination

We may terminate or suspend your access to the Site, or refuse to accept your order, if you breach these Terms.
These Terms (or portions thereof) will survive termination of your use of the Site to the extent necessary to give effect to the rights and obligations incurred prior to termination.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Australia (including the Australian Consumer Law).
In the event of a dispute, the parties should first seek to resolve it amicably. If unresolved, either party may bring proceedings in a competent court of Australia.

Changes to Terms

We may revise these Terms at any time. Revised Terms will be posted on the Site with an updated ”effective date” and will take effect immediately. Continued use of the Site after any changes signifies your acceptance of the revised Terms.
